On September 21, 2000, Ntegrity Telecontent Services, Inc. (NTS), filed an application for a certificate to provide resold and facilitities-based basic local telecommunications service in portions of the state of Missouri. On November 20, 2000, NTS filed a Motion to Amend Application by Interlineation. Counsel for NTS states that he inadvertently used an outdated form of application that did not take into account Commission revisions and renumbering of rules and revision of the listing of standard rule and statutory waivers as of April 30, 2000. The motion states the intended waiver requests to be substituted in the original application.
NTS state that rule 4 CSR 240‑2.080(21) allows a pleading to be amended at any time by leave of the Commission. NTS states that no procedural schedule has been set for this case, nor has any stipulation or agreement yet been filed.
The Commission has not yet taken action regarding the application. The motion to amend is timely and will permit the Commission and the parties to address the merits of the application as intended to be filed by NTS. The motion will be granted.
IT IS THEREFORE ORDERED:
1. That the Motion to Amend Application by Interlineation filed by Ntegrity Telecontent Services, Inc., on November 20, 2000, is granted.
2. That this order shall be effective on December 14, 2000.
