The parties are advised
that, upon the retirement of Senior Regulatory Law Judge Bill Hopkins, this
matter has been reassigned to Deputy Chief Regulatory Law Judge
Kevin A. Thompson.
On July 29, 2003, Union
Electric Company, doing business as AmerenUE, filed its application for a
variance from Commission Rule 4 CSR 240-20.050, relating to metering, and from
Section II.K., Non-Standard Service, of its Schedule 5, Schedule of Rates for
Electric Service. Applicant seeks a
variance to permit master metering for a residential apartment building that
its customer, the St. Louis Housing Authority, intends to renovate and use as
housing for low to moderate income persons with disabilities or physical challenges.
Together with its
application, Applicant filed its Motion for Admission Pro Hac Vice of
its Associate General Counsel, Edward Fitzhenry, a member in good standing of
the bar of the state of Illinois. On
July 30, the Commission directed Applicant's counsel to provide certain
additional information in support of the application for admission pro hac
vice. This was done on August 11.
The Commission will
admit Mr. Fitzhenry for the purpose of this proceeding.
The Staff of the Missouri Public Service Commission shall file its Memorandum and Recommendation, stating whether or not the requested variance should be granted, no later than September 19, 2003.
IT IS THEREFORE ORDERED:
1. That Edward C. Fitzhenry is admitted to practice before this Commission pro hac vice during the pendency of this matter.
2. That the Staff of the Missouri Public Service Commission shall, no later than 4:00 p.m. on September 19, 2003, file its Memorandum and Recommendation stating whether or not the variance sought herein by Union Electric Company, doing business as AmerenUE, should be granted.
3. That this Order shall become effective on August 29, 2003.
