PR-08-29 -- PSC Sets Intervention Deadline In Territorial Agreement Case

  FOR IMMEDIATE RELEASE -- AUGUST 21, 2007

JEFFERSON CITY—The Empire District Electric Company (Empire) and Ozark Electric Cooperative (Ozark) have filed a joint application with the Missouri Public Service Commission seeking Commission approval of an electric territorial agreement which designates the provider of electric service to a tract of land located just south of the City of Republic in Greene County.

The joint application states the territorial agreement is in the public interest because it will prevent future duplication of electric service facilities and will allow electric service customers within the area to know with certainty the supplier of their service.

Under the proposed territorial agreement, Ozark will acquire certain electric facilities from Empire and the agreement, if approved, will result in a change of electric supplier for some customers.

Applications to intervene and participate in this case must be filed no later than September 6, 2007, with the Secretary of the Missouri Public Service Commission, P.O. Box 360, Jefferson City, Missouri 65102. Copies of the application should be sent to: Gary W. Duffy, Brydon, Swearengen & England, P.C., 312 East Capitol Avenue, Jefferson City, Missouri 65102-0456; Rodric A. Widger, Andereck, Evans, Milne, Widger & Johnson, L.L.C., 1111 South Glenstone, Suite 2-100, Springfield, Missouri 65804; and the Office of the Public Counsel, P.O. Box 2230, Jefferson City, Missouri 65102-2230.

The Office of the Public Counsel is a separate state agency that represents the general public in matters before the Commission. Individual citizens wishing to comment should contact either the Office of the Public Counsel (Governor Office Building, 200 Madison Street, Suite 650, P.O. Box 2230, Jefferson City, Missouri 65102-2230, telephone 573-751-4857, e-mail opcservice@ded.mo.gov) or the Public Service Commission Staff (P.O.
